NAIROBI - A man on Wednesday filed a petition seeking to have the local authorities scrapped and be replaced by county governments in accordance with the provisions of the new constitution.

Samson Ndindi Nyoro says that the country's local authorities have failed to perform their duties effectively arguing that they were a waste of national resources.

In a sworn affidavit, Nyoro who hails from Murang'a County claims that it was too expensive to maintain both the local authorities and the county government and is asking the court to intervene arguing that the issue is of great interest.

Elsewhere, High court judge Roselyn Wendoh has disqualified herself from hearing an election petition against Gatundu North Member of parliament Clement Waibara.

Waibara had requested Wendo to disqualify herself from hearing the petition arguing that he might not get a fair hearing.

Wendoh directed that the file be forwarded to the Chief Justice within seven days for directions.

Former Gatundu Member of Parliament Patrick Muiruri is challenging the election of Waibara on grounds that the current MP never sat for a language proficiency tests.

And at the Court of Appeal, a three judge bench has ordered an investigating officer to produce missing files within 60 days in the interest of justice.

James Kamau Kariuki is appealing against a death sentence handed to him 10 years ago.
