COE Draft goes to parliament: Debate to start in 7 days

NAIROBI - The Committee of Experts on Constitutional Review is calling on the 10th parliament to learn from past mistakes past and put aside their political differences so as to steer the constitution making process ahead.



Committee Chairman Nzamba Kitonga noted that the 9th parliament allowed battle for political supremacy to derail the process as he urged MPs not to let the rift in the coalition government divert their focus on reforms.

PSC Chairman Abdikadir Mohammed expressed optimism that parliament will debate the draft with sobriety to ensure that Kenyans get a new constitution.

The experts replaced their earlier proposal of a Hybrid system of governance with a pure Presidential system as recommended by PSC.

Other changes include retention of clauses in the Bill of Rights that had been expunged by PSC, a two tier devolution and outlawed abortion.

CoE also restored the requirement to vet all judges. PSC will study the document for 7 days before tabling it in parliament for debate.

Parliament has 30 days to debate and adopt the document before PSC returns the draft to the Nzamba Kitonga led committee with proposed amendments for the experts to prepare the final draft constitution to be forwarded to the Attorney General for publication.
